Major Legislative & Judicial Developments

  • ​The Parliament has officially cleared the Supreme Court (Number of Judges) Amendment Bill, 2026, increasing the sanctioned strength of apex court judges from 34 to 38, which includes the Chief Justice of India.
  • ​The Bill, passed by the Rajya Sabha on August 5, 2026, replaces a May 2026 Ordinance and marks the first expansion of the Supreme Court’s judicial strength since 2019.
  • ​This legislation was passed as a money Bill, a legislative route that remains legally controversial, as a pending seven-judge Constitution Bench is expected to examine the validity of categorizing such laws under Article 110.
  • ​Union Law Minister Arjun Ram Meghwal highlighted that this judicial expansion is a strict necessity to address massive case pendency, noting that there are currently over 96,000 cases pending in the Supreme Court, 64.72 lakh in High Courts, and nearly 4.98 crore across district and subordinate courts.
  • ​To support this expansion, an infrastructure project worth ₹795.53 crore is actively underway at the Supreme Court to construct 28 new courtrooms, nine Constitution courtrooms, and 42 additional judges’ chambers.
  • ​The Rajya Sabha also passed the Registration of Births and Deaths (Amendment) Bill, 2026, on August 4.
  • ​This proposed legislation implements significantly stricter scrutiny for delayed registrations, mandating that births or deaths registered beyond a two-year delay will now require an official order from a first-class judicial magistrate, shifting the authority away from executive magistrates for late filings.
