Australia student visa family ban: what Indian students should check
Australia student visa family ban news is simple once you know the words. From 17 September 2026, Australia said most new international students and many graduate-visa holders will not be allowed to attach a partner or child to their visa. India is not in ASEAN, so a typical Indian bachelor or taught-masters plan is inside this change. This page is a student explainer, not a visa service. The official notice always wins.
If a consultancy is already selling a “family package” for a 2027 intake, pause. Read the Home Affairs speech and media release first. Then decide whether you still apply, apply alone, wait for a PhD track, or pick another country.
First, the basic words
You do not need a law degree. You need these four terms.
- Student visa (subclass 500): the main visa that lets you study in Australia. One person is the primary student. Other people on that file are secondary applicants.
- Secondary applicant / dependant: usually a spouse, de facto partner, or a child under 18 who travels with the student.
- Graduate visa: a temporary work visa after you finish a course. The speech said family attach rules will also tighten here.
- Visa hopping: finishing one course and jumping to another course mainly to stay in the country and work, not to study a harder programme.
ASEAN means ten South-East Asian countries (Singapore, Malaysia, Indonesia, Thailand, Vietnam, Philippines, Myanmar, Cambodia, Laos, Brunei). India is not on that list. Pacific island countries are a separate exception. A PhD is a research doctorate, not a one-year taught masters.
What Australia actually announced
Home Affairs Minister Tony Burke spoke at the National Press Club on 17 September 2026. The government also put out a media release the same day. The student-relevant lines are these.
- New international students will, in most cases, no longer be allowed to attach family members. The same direction was stated for graduate visas.
- Exceptions: special visa conditions will still allow family for Pacific and ASEAN students, and for certain courses such as PhDs.
- Families already in Australia on a linked visa are not being split. Burke said people already onshore stay as they are until they leave, unless they later get a permanent visa.
- Student visa “progression” will only be allowed up the qualification scale. Bachelor to masters is up. Sliding into a cheaper, easier course to keep working is the model they want to stop.
- New visitor visas will carry a “no further stay” condition, so a tourist stamp is not an easy onshore jump to another visa.
- The Budget target for net overseas migration is 245,000 this financial year and 225,000 in 2027–28.

What changes in a normal Indian student file
Until now, many Indian families treated the partner visa as part of the finance plan. The partner could work (hours depend on the student’s course). School-age children needed extra funds in the financial-capacity test. That model is what the new rule is trying to shrink for future applicants from countries outside the exception list.
For a new Indian bachelor or taught-masters file, plan as if you travel alone unless Home Affairs later publishes a written exception that names your course. Do not use a newspaper headline as the exception. Use the grant letter.
Money math also changes. If the second adult cannot work in Australia, the household income you counted on is gone. Living cost, rent, and tuition still have to be shown from funds you already have, or from a parent income that meets the published threshold. What you should do this week
- Open the 17 September speech and the media release. Save the PDFs or print the pages. Dates matter when an agent argues later.
- If you have an offer letter, write three lines: course level (bachelor / taught masters / research PhD), intake month, whether any family member was going to be a secondary applicant.
- Email the university international office, not only the agent: “Will my 2027 intake still allow a secondary applicant under the 17 September 2026 settings?” Keep the reply.
- Rebuild the budget as a single-student file. If the plan only worked because a spouse would earn in Australia, the plan is broken. That is a skip-or-delay fact.
- If an agent asks for extra money to “lock family seats”, stop. There is no public seat auction. Pay only official tuition and visa fees listed on university and Home Affairs pages.

Common traps
- “We will put the spouse on a visitor visa.” New visitor visas are meant to carry a no-further-stay condition. That is a visit, not a study-and-work life. Do not build a two-year plan on a tourist stamp.
- “We will start a cheap diploma and upgrade later.” The speech said you may go up the scale, not down into a lighter course to keep working.
- “India will get an ASEAN-style exception.” No official line says that. Until a written instrument names India, treat Indian taught courses as restricted.
- “Pay us now, rules will be notified later.” If the official PDF is not out, you do not pay a private “notification fee”.

I am in class 12. Should I drop Australia from my list?
No. Drop the family-accompaniment assumption. If you can study alone and the degree still makes sense against fees and job odds, keep the file. If the family had to come for the plan to work, look at India, Germany, or a later PhD route.
Does a one-year masters count as a PhD exception?
No. A PhD is a research doctorate. A taught masters is a different course level. Wait for the written instrument if your university claims otherwise.
We already paid an agent.
Ask for a written note of what was paid, towards which university invoice. Do not pay a second “family correction” fee. If the money was only a consultancy charge, treat it as spent advice, not a visa.
