Tug-of-War Over Investigative Agencies

  • ​The Supreme Court is currently examining awhether to transfer a high-profile bribery case involving an Enforcement Directorate (ED) officer, Ankit Tiwari, from the Tamil Nadu Directorate of Vigilance and Anti-Corruption (DVAC) to an independent central agency like the CBI.
  • ​Officer Tiwari was allegedly caught accepting a ₹20 lakh bribe. However, the ED argues that the state’s DVAC proceedings are an act of political revenge against the central agency.
  • ​A Bench headed by Chief Justice of India Surya Kant has refused to lift the stay on the criminal proceedings.
  • ​Crucially, the apex court has suggested the need to evolve a screening mechanism to determine whether political vendettas are motivating central agencies to target opposition-ruled states, or if states are retaliating by arresting local central officers.

Medical College Fee Structures

  • ​In a significant ruling for medical education, the Supreme Court stated that private medical colleges cannot be forced to match the lower tuition fees of government institutions.
  • ​A bench consisting of Justices B V Nagarathna and Joymalya Bagchi noted that preventing private colleges from charging higher fees would likely result in their closure, ultimately harming medical education.
  • ​While strictly reiterating that private institutions are barred from taking capitation fees, Justice Nagarathna clarified that the “annual tuition fee can’t be the same in a private college and a govt one”.

Homebuyers Retain Right to Seek Delay Compensation

  • ​In a major win for real estate consumers, the Supreme Court ruled that taking physical possession of a flat does not bar homebuyers from raising deficiency complaints against developers.
  • ​A bench comprising Justices Vikram Nath and V Mohana affirmed that homebuyers can still approach consumer forums to seek compensation for delayed possession even after they have taken custody of their property, setting aside contrary reasoning by the NCDRC.
